Oct. 3, 2005 Organizations File Brief to Rehear R-CALF vs. USDA Case Twenty-three organizations have filed an amicus curiae brief, or friend of the court brief, supporting a petition by Ranchers-Cattlemen Action Legal Fund United Stockgrowers of America (R-CALF USA) to rehear its case challenging the U.S. Department of Agriculture (USDA), R-CALF reported last week. R-CALF filed the petition Sept. 8 in reaction to a judgment issued by a three-judge panel in July that overturned a preliminary injunction placed on Canadian beef and beef product imports into the U.S. The 31-page brief argues that the court wrongfully reversed the preliminary injunction, and criticizes USDA actions surrounding its final rule on bovine spongiform encephalopathy (BSE). Japan Reacts to Trade Threats Japanese officials have reacted to remarks made by U.S. legislators last week promising trade consequences should Japan fail to reopen its markets to U.S. beef. According to meatingplace.com, the countrys Minister of Agriculture, Forestry and Fisheries, Mineichi Iwanaga, said the Japanese government is committed to leaving the decision whether to reopen markets to its Food Safety Commission, which has shown few signs of approving trade. ERS Releases Manure Report USDAs Economic Research Service (ERS) released a report detailing ways to reduce potential air and water quality degradation caused by animal waste from confined animal feeding operations (CAFOs). The report assesses the economic and environmental tradeoffs between water quality policies and air quality policies that could require the animal sector to take potentially costly measures to abate pollution.
