Industry Organizations Granted Role in Border Case

Several industry organizations have been granted “friend of the court” status in the legal case between Ranchers-Cattlemen Action Legal Fund United Stockgrowers of America (R-CALF USA) and the U.S. Department of Agriculture (USDA).

The National Meat Association (NMA) and the Canadian Cattlemen’s Association (CCA) both announced yesterday that the Ninth Circuit Court of Appeals accepted their respective amicus briefs, giving each organization a chance to voice its concerns to the Court regarding the preliminary injunction in effect since early March that prevents Canadian live cattle imports.

According to CCA, amicus briefs were also granted for the Alberta Beef Producers (ABP), the Canadian government, American Farm Bureau Federation (AFBF) and the National Cattlemen’s Beef Association (NCBA). In addition, NMA reported other associations granted similar status include: the American Meat Institute (AMI) and North American Meat Processors (NAMP), Easterday Ranches and Pioneer Inc., Southwest Meat Association (SMA), Eastern Meat Packers Association, United Food and Commercial Workers (UFCW), Camelid Alliance, National Pork Producers Council (NNPC), Tyson Foods Inc., and other state groups and individual producers.

A string of amicus brief filings by industry organizations and others began pouring in shortly after USDA appealed the decision in favor of the preliminary injunction. Last week, yet another group, the Cattlemen’s Competitive Market Project (CCMP) — with co-signers Consumer Federation of America (CFA) and Public Citizen — filed an amicus brief in support of R-CALF.

The Court will begin hearing oral arguments July 13 in Seattle, Wash., in USDA’s appeal of the preliminary injunction. Final trial hearings are scheduled for July 27 in Montana.

Beef Prices at the Consumer Level

USA Today released an article yesterday highlighting the rising retail price of beef. Tight cattle supplies due to drought and the Canadian import ban have contributed to high prices, the article notes.
